Terms of service.

These Terms govern access to and use of bay82 studio websites, consumer mobile apps, and Macro — the content-management tool we offer to fitness and wellness creators for drafting TikTok photo carousels. By using anything we make or operate, you agree to these Terms.

Who we are

bay82 studio is a small product studio based in Emeryville, California, operating as Bay82 Studio LLC. We build and operate a portfolio of consumer mobile apps and a separate product for creators — Macro — which helps fitness and wellness creators draft TikTok photo carousels and send them to their own TikTok inbox for review.

Eligibility and accounts

To use Macro, you must be at least 13 years old, hold a valid TikTok account that you own or are authorized to manage, and be capable of forming a binding contract with us. If you're using Macro on behalf of a brand or organization, you represent that you have the authority to do so on its behalf.

You are responsible for keeping your account credentials secure and for activity that happens under your account. If you suspect unauthorized access, contact us so we can help.

Use of our services

You agree to use our websites, apps, and Macro lawfully and responsibly. That means no using bay82 services to break the law, infringe someone else's rights, or harm other people.

You also agree not to misuse our services, interfere with their normal operation, reverse engineer them, probe them for vulnerabilities without permission, or attempt to gain unauthorized access to any account, system, or data.

Macro and TikTok integration

Macro is a content-management tool that lets you, the creator, draft TikTok photo carousels in our editor and send those drafts to your own TikTok drafts inbox for review and publishing. Macro is a third-party tool you connect to your own TikTok account — it is not operated by or affiliated with TikTok.

When you connect your TikTok account, Macro uses TikTok Login Kit (OAuth) and the TikTok Content Posting API. We request only the scopes needed to operate the service: user.info.basic (to display your handle and avatar inside Macro) and video.upload (to send your drafts to your TikTok inbox). We do not request permission to publish on your behalf.

Macro does not auto-publish. Drafts arrive in your TikTok inbox. You open the TikTok app, finalize the caption, select audio, and publish manually. The act of publishing is always done by you, inside TikTok.

Your use of TikTok through Macro is also subject to TikTok's own terms, community guidelines, and developer policies. Where TikTok's rules apply, they apply in addition to these Terms. You are responsible for ensuring the content you draft and publish complies with both these Terms and TikTok's rules.

You can disconnect Macro from your TikTok account at any time from inside Macro, or directly from TikTok at Settings → Privacy → Manage app permissions.

Content and ownership

bay82 and its licensors own the bay82 websites, designs, software, trademarks, logos, and content we make. Nothing in these Terms transfers those rights to you.

You retain all rights, title, and interest in the content you upload to Creator Suite — your photos, captions, and drafts. You grant bay82 a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and transmit that content solely as needed to operate Macro for you (for example, storing your drafts and uploading them to your TikTok inbox at your request).

We do not use your content to train generative models, sell it to third parties, or display it as marketing material. Macro does not add watermarks, logos, or promotional text to the content you upload.

Prohibited uses

You agree not to use Macro to:

  • Upload content you do not have the rights to use.
  • Post or draft content that violates TikTok's Community Guidelines, including content that is harassing, sexually exploitative, hateful, or otherwise prohibited on TikTok.
  • Impersonate another person, brand, or organization.
  • Engage in spam, coordinated inauthentic behavior, follower farming, or other behavior designed to manipulate platform metrics.
  • Run multiple accounts in a way that violates TikTok's rules on account management.
  • Attempt to bypass the inbox-upload review step or otherwise use Macro to publish content without human review.

We may suspend or terminate access to Macro if we have a good-faith belief that you have violated these rules or TikTok's rules.

Third-party services

We rely on third parties to run the service: our cloud hosting and database providers, our email provider, TikTok itself, and (for our consumer apps) the Apple and Google app stores.

Each of those services has its own terms and privacy practices, and your use of them through bay82 is also subject to those terms. We choose our partners carefully but we don't control them.

No warranties

Our services are provided “as is” and “as available.” To the maximum extent permitted by law, bay82 disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the services will be uninterrupted, error-free, secure against every threat, or that any specific result (audience growth, engagement, revenue) will be achieved by using them.

Limitation of liability

To the maximum extent permitted by law, bay82 — and its officers, employees, and affiliates — will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the services. That includes lost profits, lost revenue, lost data, and business interruption, whether based in contract, tort, or any other legal theory.

Some jurisdictions don't allow certain limitations of liability, so parts of this section may not apply to you.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the services will be resolved in the state or federal courts located in Alameda County, California, and you and bay82 consent to the personal jurisdiction of those courts.

Termination

You may stop using Macro at any time. You can disconnect your TikTok account from inside Macro, request deletion of your Macro account by emailing us, or simply stop signing in.

We may suspend or terminate your access to the services if you violate these Terms, if required by law, or if continued operation poses a security or operational risk. Sections that by their nature should survive termination — ownership, disclaimers, limitation of liability, governing law — will survive.

Changes

bay82 may update these Terms from time to time. When we do, we'll update the “last updated” date at the top of this page. If a change is significant, we'll make a reasonable effort to flag it.

Continued use of the services after an update means you accept the updated Terms. If you don't agree with the changes, the right move is to stop using the services.
